Centre Proposes Customised Article 371 Model for Ladakh

The Union Ministry of Home Affairs has released the official minutes of its high-level meetings with prominent civil society groups from Ladakh, signaling a major breakthrough. The central government has formally proposed a unique, customized “sui generis” governance framework under Article 371 of the Constitution. This development aims to end the prolonged political deadlock and address the local population’s representation concerns.
This newly proposed framework serves as an alternative to the Sixth Schedule protections that regional groups previously demanded. The customized model will draw features from existing constitutional protections given to states like Nagaland, Sikkim, and Mizoram. It is specifically designed to legally protect Ladakh’s unique tribal culture, local employment, and land rights from outside demographic shifts.
Under this plan, Ladakh will transition away from an entirely bureaucrat-led administration to a more democratic setup. A Union Territory-level elected legislative body will be established to give the local people a direct political voice. This new overarching institution is expected to operate in complete harmony with existing grassroots Panchayati Raj Institutions.
Crucially, this proposed elected body will possess distinct executive, financial, and legislative authority over local matters. In a notable administrative shift, the elected representatives will exercise direct control and supervision over civil servants managing these local subjects. This includes the authority to review and appraise bureaucratic performance, ensuring direct accountability to the public.
While local leaders continue to advocate for full statehood, the central government cited immediate financial constraints, particularly operational expenses and employee salaries, as the reason for maintaining the Union Territory structure for now. However, the official minutes formally acknowledge that full statehood remains the long-term aspiration for the people of Ladakh as the region builds independent revenue generation.
